1. Agency Role & Nature of Services

The Nanny Union Agency acts as an introductory agency. We facilitate the introduction of childcare professionals (Candidates) to families (Clients). We are not the employer of the Candidates. The Client is solely responsible for the legal employment of the Candidate, including but not limited to contracts, PAYE, National Insurance, and statutory workplace pensions, in accordance with UK law.

2. Website Use

By using our website, you agree not to use the site for any purpose that is unlawful or prohibited by these Terms. You may not use the site in any manner that could damage, disable, overburden, or impair the site or interfere with any other party's use of the site. All content, imagery, and text on this website are the intellectual property of The Nanny Union Agency and may not be copied or reproduced without permission.

3. Vetting & Liability

While we conduct rigorous screening, interviews, and background checks (including Enhanced DBS and reference verification), it remains the Client’s ultimate responsibility to ascertain the suitability of a Candidate for their specific household. The Nanny Union Agency shall not be held liable for any loss, damage, expense, or injury resulting from the introduction or employment of a Candidate.

4. Fees & Placement Invoicing

4.1 Registration Fee: A one-off, non-refundable registration fee of £150 is payable upon initial application to initiate administrative onboarding, bespoke candidate sourcing, advertising, family consultations, and pre-vetting (including Enhanced DBS and Home Office verification checks).

4.2 Placement Credit: Upon the successful placement and engagement of an introduced Candidate, the entire £150 registration fee is 100% credited and deducted from the Client's final placement invoice.

4.3 Placement Fee Balance: The remaining placement fee balance, invoicing schedules, and ongoing support terms are detailed in the formal Client Placement Agreement executed prior to candidate commencement.

5. Search Scope & Non-Refundability Policy

5.1 Single Placement Scope: Each completed registration application and £150 fee initiates a dedicated search for one (1) nanny position only. If a Client requires multiple childcare professionals (such as rota teams, separate weekend support, or staff across multiple residences), a separate registration application and fee is required for each distinct placement.

5.2 Non-Refundable Fee Justification: The £150 registration fee is strictly non-refundable under all circumstances once paid. This fee covers non-recoupable administrative and operational overheads incurred immediately upon receipt, including customized vacancy marketing, consultant intake evaluations, Home Office right-to-work verification, and background checks.

5.3 Replacement Guarantee: Post-placement candidate replacement policies, probationary protections, and guarantee periods are governed separately under the signed Client Placement Agreement.

6. Confidentiality

Both Clients and Candidates agree to treat all introductions and personal information as strictly confidential. Clients may not pass candidate details to third parties. Candidates must maintain strict discretion regarding the private affairs of the families they are introduced to or employed by.

7. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

8. Changes to Terms

We reserve the right to modify these terms at any time. We recommend that you check this page periodically for updates. Your continued use of the website following the posting of changes will mean that you accept those changes.
